Health, Safety and Welfare at Work Health and safety in the workplace is not only the responsibility of the designated Health and Safety Officer, it is the duty of all members of staff to be responsible for the safety of everyone they may have to deal with during the working day; both their colleagues and members of the public. The Health and Safety Executive are a body whose role is to promote safety in the workplace; both by providing information to employers and their employees, and also by ensuring that rules and guidelines are adhered to in everyday practice. According to the Health and Safety Executive (or H&SE), the employer has a responsibility under law to ensure, as far as is reasonably practicable, the employee's health, safety and welfare at work. The employer's duties include: - Making the workplace safe and without risks to health - Ensuring that plant and machinery are safe and that safe systems of work are set and are followed - Ensuring articles and substances are moved, stored and used safely - Providing adequate welfare facilities - Giving the information, instruction, training and supervision necessary for health and safety It is the duty of the employer to assess the risks to the health and safety of his/her staff. This will often necessitate a vigorous and thorough inspection of the workplace, paying particular attention to any piece of equipment or plant and any working practice that may be hazardous to the safety of staff. If there are 5 or more employees, any findings of the risk assessment must be recorded. Plant and machinery must be regularly inspected to ensure that it is... ...struction-phase health and safety plan. This must be done before any construction work begins. - The client must be reasonably satisfied that all those who are appointed are competent to carry out all their health and safety responsibilities. - The client must ensure that the health and safety file that was compiled during the construction process is kept readily available for inspection by anyone who may want to conduct any further construction work on the site in the future. The client may choose to appoint an agent to act on their behalf. In these circumstances the client must ensure that any person appointed in this capacity is fully competent and qualified to carry out their health and safety responsibilities. Natural Law and Sexual Ethics by Janet Smith Essay
I am honored to be among the lecturers in this series on natural law. Many of the speakers are among my heroes and friends. One of my heroes, Alasdair MacIntyre, used one of his favorite terms in his talk: he spoke of ââ¬Å"plain personsâ⬠and their grasp of morality and natural law in contradistinction to the experts and professional philosophers and their grasp of these matters. A few years ago in Dallas he gave a talk entitled ââ¬Å"Do plain persons need to be moral philosophers? â⬠When I was asked to give the response to his talk, I was most honored because I considered Prof. MacIntyre one of the foremost moral philosophers in the world and it was a thrill to comment on his work. I felt dreadfully underqualified ââ¬â I felt like some high school kid going up against Larry Bird ââ¬â until I realized that I need not respond as an expert, as a moral philosopher of his caliber, but that I could respond as the quintessential plain person ââ¬â for that is what I am. After all, I am Janet Smith, daughter of John and Anne Smith; I grew up at 5 Hill Street and went to Home Street School ââ¬â I could go on but it is all very plain. The point I am making here is not merely a flip one ââ¬â designed to ease us into more serious matters through an attempt at humor. There is a serious point here ââ¬â natural law, is the ââ¬Å"plain personââ¬â¢sâ⬠morality ââ¬â in a sense it is simply plain old common sense. There are profound and sophisticated ways at explaining natural law, but the practiceof reasoning in accord with natural law principals, according to the theory itself, is natural to plain persons ââ¬â that is, natural to all mankind for natural law holds that many of the most fundamental principles of moral reasoning are obvious, that is easily known by all. Yet, in spite of the plain commonsensicalness of natural law, it can seem shocking and provocative in many ways, for like natural law, plain old common sense does not command a lot of followers these days and can be shocking when juxtaposed to the values of our times. My talk is going to be very basic in several respects. It will review some of the basic principles that other speakers have covered, some in depth, some more in passing. It will also be very basic in being the one talk that attempts to make an application of natural law to concrete moral issues; issues in the realm of sexual ethics. My job is not to justify natural law ethics but to explain it and apply it. As did many of the earlier speakers I will largely be following the thought of Thomas Aquinas on these matters and of Aristotle from whom Aquinas learned many of the principles that informed his teaching on natural law. I shall also incorporate into my arguments the thought of another stellar natural law theorist, still alive and well: I shall make use of the work of Karol Wojtyla, now known as Pope John Paul II. I will refer to him as Wojtyla simply because I do not want to be thought to be invoking his authority as Holy Father; I cite him simply as a philosopher who has made great advances of our understanding of natural law, particularly in regard to sexual ethics. So let me begin with a review of the principles of natural law. As several other speakers have noted, Aquinas maintains that the first principle of natural law is ââ¬Å"do good, avoid evilâ⬠. As he notes, that is a self-evident principle and obvious to all; if we want to be moral we should do good and avoid evil. No controversy here. The question is, of course, what is good and what is evil and how to we come to know which is which? Some think we canââ¬â¢t know what is good and evil so the best we can do is live by the conventions of our times. Others think it best to let our passions be our guide to whatever we want to do. Others think only revealed religion can give us absolutes. These three positions capture the predominant views of our times. Aquinas holds none of these positions. He argues that reason should be our guide to morality. Not only does he hold that the first principle of natural law, ââ¬Å"do good, avoid evilâ⬠is self-evident, he argues that there are other self-evident first principles, such as ââ¬Å"harm no manâ⬠. These he says are imprinted in the minds of all by God; I believe other precepts such as ââ¬Å"provide responsibly for your offspringâ⬠, ââ¬Å"give to each man his dueâ⬠and ââ¬Å"seek knowledgeâ⬠would qualify as precepts that Aquinas thinks all men know. Men (and I use the term generically here and throughout) may act against these precepts out of passion or because ignorance of some fact operative in a situation, but all would agree that such principles are moral truths. Aquinas goes on to say that what he calls primary precepts of natural law are naturally and immediately known by man; he cites the 10 commandments as examples of these types of precepts. These precepts are justified by the primary principles. From the most general principle ââ¬Å"give to each man his dueâ⬠, from an understanding of what one owes to oneââ¬â¢s mother and father, it is clear that one ââ¬Å"should honor oneââ¬â¢s father and mother. ââ¬Å"Now this is not to say that one discovers the moral law by discovering these precepts in a deductive manner moving from the most general to the more particular. Rather, it seems that often moral discovery, as the discovery of other general truths, moves from the particular to the universal. That is, an individual could witness or participate in a transaction and quite immediately make the moral judgment that the act is good or bad. That is, for instance, an individual could witness someone honoring or dishonoring his parents and judge the action to be good or bad; from this action and others of the same sort one may come to formulate the ââ¬Å"lawâ⬠that one should give each man his due. But it is because we already naturally know ââ¬â in an unexpressed and unformulated way ââ¬â that one should give each man his due, that we are able to see readily that honoring oneââ¬â¢s parents is good. Much in the same way that we, without musical training, can judge certain tones to be off pitch, we have moral ââ¬Å"perceptionsâ⬠that some actions are good and some bad, without having any explicit training about such kinds of actions. I speak of these as moral ââ¬Å"perceptionsâ⬠not because they are equivalent to sense perceptions, but because of their immediacy and their unformulated quality; indeed, I believe them to be rational in several important respects, not least because they are cognitive acts and they are in accord with reality. Let me speak now about rationality and the Thomistic claim that ââ¬Å"one should act rationally. â⬠Indeed, one could formulate the first principle of natural law not only in the most basic formula ââ¬Å"do good, avoid evilâ⬠; in Thomistic terms, several formulas serve to express the same truth: for Aquinas, the following phrases are synonymous: ââ¬Å"act in accord with natureâ⬠; ââ¬Å"act in accord with reasonâ⬠or ââ¬Å"act rationallyâ⬠; ââ¬Å"act in accord with virtueâ⬠; ââ¬Å"act in accord with the dignity of the human personâ⬠; ââ¬Å"act in accord with a well formed conscienceâ⬠; indeed, ââ¬Å"act in a loving wayâ⬠, properly understood, serves as well. While it would be of great profit to elaborate how each of these phrases is synonymous with the other, I want to devote most of my efforts here to explaining how ââ¬Å"act in accord with natureâ⬠and ââ¬Å"act in accord with reasonâ⬠are synonymous and worthy guides to moral behavior. First we must try to get as clear as we can what it means to say ââ¬Å"act in accord with reasonâ⬠or ââ¬Å"act rationallyâ⬠. In our day, reason often gets a bum rap. This is a fault not of Aristotle or Aquinas but of Descartes and Kant and their followers. Since they retreated into the mind and abandoned the senses and emotions and nature as guides to truth, they made reason seem like something coldly logical, impersonal, abstract and completely devoid of experiential and emotional content. In their view, mathematics and geometry are seen as the quintessential rational acts; to be rational is to operate totally within oneââ¬â¢s mind and to be completely unemotional. Another view of rationality that dominates modern times is the view that only that which can be measured scientifically deserves any recognition as objective truth. No truths other than those substantiated by scientific proofs ââ¬â truths that can be quantified largely in the laboratory ââ¬â count as truth. No proof other than scientific proofs count as truth; only science and that which approximates to scientific truth is truly rational. Neither view is the view of reason and rationality held by the ancients and medievalists ââ¬â those who defined the view of natural law I am defending here. The ancients and medievalists did not think rationality was possible without the senses and the emotions for both are tools to reading reality; they provide the intellect with the material needed to make a good judgment. The etymology of the word ââ¬Å"rationalâ⬠is rooted in the word ââ¬Å"ratioâ⬠which means ââ¬Å"measure or ââ¬Å"proportionâ⬠. One is being rational when oneââ¬â¢s thought and action are measured to, are proportionate with, or when oneââ¬â¢s thought and action correspond with reality (which itself is measured or governed by discernable laws; more about this momentarily). The thought that leads to acting in accord with reality is called rational. Now this thought need not be and perhaps only rarely will be the kind of abstract, cold, logical reasoning of a Descartes, Kant, or research scientist. This thought can be intuitive, creative, poetic, inductive, deductive, indeed, whatever human thought can be. It is all called rational thought not because it proceeds by syllogism or because it is subject to certain scientific tests; it is called rational because it corresponds with reality ââ¬â and this includes all of reality, the spiritual and the transcendental as well as the logically provable and the scientifically measurable reality. Such thought cannot proceed without abundant data from our senses and our emotions. The intellect processes such data and orders it; it determines what values are important in the data and decides on the appropriate response. If one acts rationally, one then acts in accord with the ordering done by the intellect. While the intellect should govern the emotions, it is not a natural law teaching that all rational behavior will be devoid of emotion. Again, the emotions can provide essential data to the intellect. Emotions that are well-habituated may lead one quite spontaneously to respond correctly to situations. One may spontaneously get angry at witnessing some act of injustice and, if one knows oneââ¬â¢s emotions to be well-ordered, one could respond quite immediately and correctly to the situation ââ¬â and even angrily to the situation. Indeed, at times it may be an appropriate response to reality to rant and rave. One doing so, is properly called rational, in spite of our common parlance. This talk of the mind and of rationality as something that is measured to reality suggests, as mentioned above, that reality is a thing that can be grasped. Natural law depends upon such. It rests upon the claim that things have natures and essences that we can know and correspond our actions to. There are many reasons for making this claim. One is the fact that things act in a predictable fashion; when we learn the properties of oil and water, for instance, we can predict certain things about their behavior. The fact that we build bridges which stand, that we make artificial hearts that work, that we put men on the moon, also indicates we are able to measure our thoughts to the external world and to act in accord with it. Moreover, natural law operates on the premise that nature is good; that is, that the way things naturally are is good for them to be; it holds that the operations of things and parts of things contribute to the good of the whole. The wings of different birds are shaped in certain fashions because of the sort of flying that they must do to survive; different digestive systems work in different ways because of what is being digested. Indeed, natural law holds that the natural instincts of natural things are good; they lead them to do what helps those things function well and helps them survive. Since natural things have an order there is said to be a ratio or order to them; not one of which they are conscious but one that is written into their functioning. Natural law holds that we live in a universe of things that have a ratio to them and that we shall get the best out of these things if we act in accord with the ratio or nature that is written into them. Now, man is a natural thing. He, too, has parts and operations and instincts that enable him to function well and to survive. Man differs from other creatures in that he has free will; that is, he can either cooperate with his nature or act against his nature, whereas other natural things have no such freedom. What enables man to be free is his reason, his rationality; he is able to weigh and measure different courses of action and to determine which actions are good or bad. According to natural law, those actions are good which accord with his nature and with the nature of other things. Since man is by nature a rational animal, it is good for him to act in accord with his reason. By acting rationally he is acting in accord with his own nature and with a reality that is also ordered. When he acts rationally, he acts in accord with his own nature and reality and in accord with the nature and reality of other things. Now, letââ¬â¢s get concrete. Letââ¬â¢s talk about acting in accord with the nature of a few specific things. Take tomato plants, for instance. Tomato plants have a certain nature. In order to have good tomato plants one must act towards these plants in accord with their nature; one must water them, give them sunlight and good soil if one wants to produce good tomato plants. Such is acting in accord with nature in respect to tomato plants, such is rational behavior in respect to tomato plants. If oneââ¬â¢s tomato plants fail to produce tomatoes, one knows that one is doing something wrong; if oneââ¬â¢s tomato plants produce good tomatoes, one knows one is doing something right. Prof. Charlie Rice, whose book Fifty Questions on Natural Law that I understand several of you are reading, speaks of the rationality of putting oil and not molasses in the engine of a car. One needs to act in accord with the nature of things if one wishes them to perform well. So now let us, moving quickly, move to human nature. If a human being wishes to function and perform well, what does his nature require of him? Let us begin with his physical nature. There is a considerable consensus about what makes for physical health and what is conducive to physical health. Those who donââ¬â¢t get sick, who are able to function well in their daily activities, who are not overweight, we call healthy. We know how to produce such individuals. We are regularly and rightly advised to eat well, exercise regularly, and to get plenty of sleep. Those who do so generally flourish physically ââ¬â because they are acting in accord with nature, with reason, and with reality. Psychological health is also understood to some extent; we know we need friends and rest and interests to sustain our psychological health; that is our nature; that is reality. Nor are we in the dark about what makes for moral health or moral goodness. We recognize the goodness of the various virtues such as self-discipline, reliability, justice and fairness, kindness, truthfulness, loyalty, etc. those who exhibit these qualities we generally recognize to be good ââ¬â that is morally good ââ¬â human beings. Parents who have children who display such qualities are rightly proud of them; their ââ¬Å"tomato plantsâ⬠turned out well. So, in regard to sexual behavior, to sexual moral health, so to speak, what qualifies as acting in accord with nature, with reason? How do we determine what it is? Now, for Aquinas, these are not difficult questions, though, apparently, they are extremely difficult questions for modern times. We are terribly confused about what proper sexual behavior is. College newspapers are filled with news of campuses that are devising codes of moral sexual behavior ââ¬â codes that are designed primarily to stop or reduce the incidence of date rape on campus. These codes suggest, mandate, require ââ¬â I am not certain what is the correct word ââ¬â that in sexual activity neither individual proceed to the next level of sexual activity without obtaining the permission of the other individual. These codes reflect what has been the principle governing sexual behavior in modern times for sometime ââ¬â whatever one feels comfortable with and whatever one agrees to is morally o. . This is basically what we are teaching to our young people and they are doing much what one would expect given that teaching. As long as it feels good, and they have consented to it, there is no reason for them not to do ââ¬Å"itâ⬠. Is this working; is this principle leading to moral health or moral sickness? What can we say about the moral sexual health of our society? What does the fact that 68% of African-American babies are born out of wedlock suggest? The figure is now 22% in the white community and rapidly growing.

Should Free Will Be Free - 904 Words
When it comes to talking about the idea of ââ¬Å"free willâ⬠there are a lot of factors involved. I think itââ¬â¢s difficult to just openly say yes or no to the question of ââ¬Å"Do all humans have free will?â⬠, because there are certain cases on each side where things aren t so black and white. When first thinking about this question, I went back and forth on my answer. It was hard to pick a side. In the end though I came up with this idea. All humans are created as free beings, and they have the free will to do as they choose. The things that seem against free will, like genetic determinism, getting sick, and your own mortality are all still your decision, but are decided more by multiple decisions instead of just one or on a more spiritual level. When talking about free will, we have to first agree that God created us to be free people, and cultural norms have advanced throughout history to support that case. All the way back to the revolution we supported a living environment where people are free to do what they choose, and we even put our freedoms in our constitution. Obviously there are rules everywhere, but just because there are rules doesn t mean they have to be followed. But the strengths of the NGO model have some corresponding weaknessesââ¬âin agenda setting, decision making, and resource allocation. A good number of international and national NGOs i. e.UNDP, CARE-India, World Vision, Action Aid, Plan International, YMCA, CHAI, States Lively Hood Projects, RASS-Tirupathi, ARTIC-Srikakulam, THREAD-Orissa, BASIX-Hyderabad, Ajim Preamjee Foundation and BCT-Visakhapatnam only exist on papers. With the support of political leaders and bureaucrats, they succeed in transforming even the profit-making bodies in the NGOs. The recent report of CAPART bears testimony to this almost all the states, the NGOs have proved to be liability because except a very few cases, almost all of them are engaged in maturing malpractices.The unfair practices promoted by the social climbers and a few the bureaucrats lead to unhealthy development. The sanction and approval of the projects are seldom based on the potentials of persons to promote and manage the project but on the pressure and influence they can wield. No one is opposed to the development of NGOs since this help the downtrodden communities, women Child, HIV/AIDS and neglected regions; but the unfair practices should be eliminated. Against this background, there are cases in favor of conceptualizing social marketing by the NGOs.The NGOs have no legal right to make profits. Therefore, the professionals, with innovative marketing practices, should try to improve their working conditions so that they can contribute significantly to the development process and succeed in removing the image problem. The marketing professionals involved in the process will be able to achieve qualitative improvements with the help of an innovative service mix. Currently, the NGOs are facing numerous problems.The increasing influence of social climbers and wrong people in the power corridors should be minimized and this is possible only when we assign due weight age to the approval and sanction process. The professionals, policy makers, promoters, social reformist and activists have to determine the priority areas for future success. ?Educational Institutions In the category of non-profit organizations, we find educational institutions playing an outstanding role. At almost all the levels, educational institutions experience numerous problems. The state policy makers should herefore think over the problem on a priority basis. At the primary, secondary and higher levels, the educational institutions are in a depleted condition. How can we talk about the government managed institutions when a majority of the private institutions present a very gloomy picture? On the one hand, there is a change in the education system because in todayââ¬â¢s conditions, expensive infrastructural facilities play an important role in improving the quality of education but because of paucity of fund, they find it is difficult to develop even the basic infrastructural facilities.The libraries, labs, supporting infrastructural facilities and the quality of faculty play an important role in improving the quality of education, but a majority of the government managed educational institutions find it difficult to promote the quality of their service mix, party, on account of financial crunch and partly because of professional deficiency. With an i ncreasing pressure of population, the demand is increasing. The users and potential users have high expectations since they witness their counterparts elsewhere in the world available of world class educational facilities which are denied to them.Weaker sections of the society and the illiterate segments need educational assistance as they cannot afford the expensive educational facilities offered by some of the privately managed schools and colleges. The universities also present the same picture. Right from the primary to the higher, almost all the centers are in a poor condition and two important reasons obstructing them are inadequacy of finance and lack of professional excellence. The syllabi of the traditionally managed educational institutions are not in tune with the emerging trends and evolving developments.There is no corresponding relation between the formal and informal education, leading to a number of allied problems. The public fail to get informal education and this obstructs the process of developing quality people. The limited number of people getting education in the world class institutions may be professionally sound but a majority of them lack informal education. They are totally unaware of traffic and civic sense and aesthetic values which keep them ignorant of work culture, conviction and commitment. So, it is necessary that educational institutions in general make ensure that both the streams of imparting educational assistance, formal and informal, are given due importance. A majority of the problems are due to inadequacy of finance and the process of mobilization of financial resources is difficult. The image problem is obstructing their professionalized efforts. They find it difficult to raise the fee structure and the donors and potential donors are disinterested in their problems. The grants from government or other agencies have shrunk.Thus they are facing a number of problems on the financial front. There appears to be no way for an improvement in their financial position. It is against this background that we recommend the urgency of conceptualizing social marketing principles by these educational institutions. Professionalize services open the doors for multi-dimensional improvements. The marketing professionals using innovative marketing strategy will be able to improve their position. Of late there has been an attitudinal change as the parents in general are quite interested in quality education.In a majority of the cases they prefer to avail of quality services even if the fee structure is high. Of late expenditure on education is considered a productive investment and this has led to a qualitative transformation. Financial institutions and commercial banks are now evincing interest in resolving the problems of the weaker sections of the society who are not unable to afford expensive quality services. Where the educational institutions are performing well and playing a positive role in the development of quality people, it is quite natural that people develop a positive attitude towards them.This will also motivate the donors and potential donors since they witness productive use of their money. This broadens the avenues for the mobilization of financial resources. Since they have been making positive contributions to the process of development, the government would also evince interest in providing adequate grants. Then the social welfare organizations too would come forward to solve their financial problems. The marketing professionals, with the help of a sound service mix, will be successful in improving the quality of the core and peripheral services.The core services can help them in regaining the lost image, while the peripheral services will add additional attractions to their service-mix. At one point in the novel, Frankensteins monster hides in a shack near De Laceys household and when he finally co nfronts one of the family members, they shout out of fear and disgust. (P.60) This is the point in the novel at which the monster decides to be the inflictor of pain instead of being the receiver as he feels that his creator, Victor Frankenstein, is responsible for his miseries and that he is the one who should pay for his crime of creating the monster.From this point onwards, Victor Frankenstein becomes the victim of the acts of cruelty. At first, the monster finds that Victor is at Ingolstadt and makes that his destination. Upon his arrival, he kills Victors younger brother, William, and frames Victors sister, Justine, for Williams death by planting a locket from Williams neck into Justines pocket. After doing this he confronts Victor and asks him to make him a female creature like himself just so that he could have a companion which would ri d him of the feeling of loneliness and perennial rejection. Victor rejects his creations request, and this angers the monster even more causing him to consider this the ultimate form of cruelty. He promises to come back on Victors wedding day. Before Victors wedding, his best friend Henry Clerval also gets killed by the monster and a short while later, Victor gets married to Elizabeth and on their wedding night, the monster kills Elizabeth. It can be inferred that the monsters final goal was to leave his creator, Victor Frankenstein in the same lonely state as himself. In conclusion, Frankenstein by Mary Shelley, is a story which has recurring acts of cruelty directed towards two main individuals, Victor Frankenstein and his monster. The monster and his creator have both been perpetrators and victims of the acts of cruelty that are in the book and this goes on to re-enforce the popular belief of the commutative nature of actions.
